Open Letter To Achmat Ebrahim Cape Town City Manager
Dear Mr. Ebrahim
After two years of interaction with the City of Cape Town on this matter, I have come to the conclusion, that the City and the parties involved in the Bonteheuwel Sports Council and the alleged “ Bonteheuwel Facility Management Committee”(FMC), even after having been made aware of the fraudulent nature of the FMC and the contract that exists between the City of Cape Town and the FMC, are actively involved in a fraudulent activity as set out in the South African Law.
In South Africa, fraud is defined as “the unlawful and intentional making of a misrepresentation which causes actual and or potential prejudice to another”. The use of the term is in its widest possible meaning and is intended to include all aspects of economic crime and acts of dishonesty.
There can be no doubt in my mind that I have clearly shown and no one in the City or any other party has been able to show that a legitimate FMC exists in Bonteheuwel, as no record exists of any General Council being held which called the Bonteheuwel FMC to life and at which an executive was elected.
The failure by the City or the Bonteheuwel FMC to account for public funds almost two years later just adds insult to injury.
The continued financing of this illegitimate body by the City, points to clear and implied complicity in the misappropriation of City Funds and Facilities.
I also wish to remind you of what the City in the form of then Mayor Helen Zille said in December 2006 when launching the Anti- Corruption Hotline. “As in any large organisation, there are hundreds of unseen, corrupt actions that may seem relatively insignificant, but that create a huge drain on our budgets. We want to clean this city up. We urge businesses, City staff, and the people of Cape Town, to use the Anti-Corruption hotline and help us stop corruption, no matter how small the case may be.”
In Light of this I urge you to take urgent and appropriate action, one that becomes the City`s response to the rampant corruption that is sweeping our country, failing which I will have no other choice but to proceed to lay criminal charges against both the Bonteheuwel “FMC” and the City of Cape town.
I trust that you will live up to the City`s public utterances against corruption and follow it up with the appropriate action.
